In 2021, the Supreme Court substantially curtailed the powers of the Voting Rights Act in Brnovich v. Democratic National Committee, upholding Arizona state laws that banned the collection of absentee ballots by anyone other than a relative or caregiver, and that threw out any ballots cast in the wrong precinct. Yet in June of 2023, in Allen v. Milligan, the Court found that the districting plan adopted by the state of Alabama for its 2022 congressional elections likely violated Section 2 of the Voting Rights Act, a decision that appeared to buttress the remaining powers of the VRA regarding redistricting. And this term, the Court heard arguments in Alexander v. South Carolina State Conference of the NAACP, regarding whether South Carolina racially gerrymandered one of its districts without a compelling interest. Surrounding the Brnovich decision, some argued that the goals of the Voting Rights Act of 1965 have been achieved, rendering the civil rights powers of the statute unnecessary. Do you agree? If not, discuss further the importance of continuing to bring voting rights litigation and/or enacting additional voting rights legislation in order to achieve racial justice in our elections.
